[Terms of Use for the Obliv Clinic Songdo Main Branch Website]

Article 1 (Purpose)
These Terms and Conditions are intended to define the rights, obligations, responsibilities, and other necessary matters between the clinic and users in connection with the use of online services (hereinafter referred to as the "Service") provided on the website (obliv.kr, hereinafter referred to as the "Website") operated by Obliv Clinic (hereinafter referred to as the "Clinic").
Article 2 (Definitions)
The definitions of the terms used in these Terms and Conditions are as follows.
1. "Website" means a virtual business place established by the Clinic using information and communications facilities such as computers and mobile devices to provide users with services such as medical information, guidance on treatment, consultation, and appointment reception.
2. "User" means a person who accesses the Website and uses the services provided by the Clinic in accordance with these Terms and Conditions.
3. "Service" means all services provided through the Website, including medical information, introduction of medical staff, procedure information, online consultation reception, appointment reception, and directions to the clinic.
4. "Content" means all information posted on the Website, including text, images, videos, documents, and designs.
5. "Operator" means Obliv Clinic, which performs the technical operation and non-medical management of the Website pursuant to a business agreement with the Clinic.
Article 3 (Posting and Amendment of the Terms)
1. The Clinic posts these Terms and Conditions on the Website so that users can easily review them.
2. The Clinic may amend these Terms and Conditions to the extent that such amendments do not violate relevant laws and regulations, including the Act on the Regulation of Terms and Conditions and the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
3. When the Clinic amends the Terms and Conditions, it will announce the changes and the effective date on the Website from 7 days before the effective date. However, if the amendment is unfavorable to users, notice shall be given from 30 days before the effective date.
4. If a user does not agree to the amended Terms, the user may discontinue use of the Service. If, when announcing the amended Terms pursuant to Paragraph 3, the Clinic clearly informs users that failure to express refusal by the day before the effective date from the date of notice shall be deemed consent, and the user does not express refusal, the user shall be deemed to have agreed to the amended Terms. However, if the user expresses refusal after the amendment takes effect, the user shall be deemed not to have agreed to the amended Terms from the time such expression reaches the Clinic.
Article 4 (Contents of the Service)
The contents of the services provided by the Clinic through the Website are as follows.
1. Introduction to the Clinic and medical staff
2. Provision of information on departments and procedures
3. Online consultation reception
4. Appointment reception
5. Directions and clinic hours information
6. Other services determined by the Clinic
Article 5 (Provision and Change of the Service)
1. As a general rule, the Clinic provides the Service to users 24 hours a day, 365 days a year.
2. However, in any of the following cases, the provision of the Service may be temporarily suspended, in which case prior notice will be given. If there is an unavoidable reason, notice shall be given without delay afterward.
- Where there are technical reasons such as regular system inspection, server expansion or replacement, or network instability
- Where there are force majeure reasons such as power outages, natural disasters, national emergencies, or administrative orders related to infectious diseases
3. The Clinic may change the contents, method of use, and hours of use of the Service, and such changes will be announced in advance on the Website at least 7 days before the effective date. If the change is unfavorable to users, notice shall be given at least 30 days before the effective date.
4. If a user does not agree to the changes to the Service, the user may discontinue use of the Service.
Article 6 (Obligations of the Clinic)
1. The Clinic shall do its utmost to provide the Service continuously and stably in accordance with relevant laws and regulations and these Terms and Conditions.
2. The Clinic manages the content posted on the Website, such as treatment information and procedure information, so that it reflects accurate and up-to-date information.
3. The Clinic protects users' personal information in accordance with relevant laws and regulations and implements technical and administrative measures for the secure handling of personal information.
4. The Clinic receives inquiries and complaints from users regarding the use of the Service and endeavors to handle them promptly.
5. The Clinic manages the medical-related information posted on the Website so that it complies with the medical advertising regulations under Article 56 of the Medical Service Act.
Article 7 (Notice Regarding Medical Information and Medical Advertising)
1. Content such as medical information, procedure information, and treatment guidance posted on the Website is prepared for general informational purposes and does not replace medical diagnosis or treatment for individual patients.
2. Information on the effects and results of procedures posted on the Website may vary depending on an individual's constitution, health condition, and treatment area. In accordance with Article 56 of the Medical Service Act and relevant laws and regulations, the Clinic does not advertise in a manner that guarantees therapeutic effects.
3. Users must not make medical judgments based solely on the information on the Website, and since side effects or complications may occur depending on individual health conditions, they must undergo examination by qualified medical professionals for accurate diagnosis and treatment.
4. Consultation and appointment through the Website are preliminary procedures for receiving medical care and do not constitute medical practice.
5. Content on the Website that constitutes medical advertising either has received review of medical advertising pursuant to Article 57 of the Medical Service Act or falls under general health information provision.
Article 8 (Users' Obligations)
Users must not engage in any of the following acts.
1. Entering false information when using the Website
2. Intentionally interfering with the operation of the Clinic's services
3. Copying, distributing, transmitting, publishing, broadcasting, or otherwise using content posted on the Website, or providing it to a third party, without the Clinic's prior written consent
4. Stealing or unlawfully using another person's personal information
5. Defaming the Clinic or a third party, or interfering with their business
6. Posting obscene or violent information, or any other information contrary to public order and morals, on the Website
7. Using the Website for commercial purposes without the Clinic's consent
8. Any other acts that violate relevant laws and regulations
Article 9 (Intellectual Property Rights)
1. Copyright and intellectual property rights in all content posted on the Website (including text, images, videos, designs, logos, trademarks, etc.) belong to the Clinic or the original copyright holder.
2. In principle, users may not reproduce, distribute, transmit, publish, broadcast, or process/edit the content of the Website for commercial or non-commercial purposes without the Clinic's prior written consent.
3. Copyright in consultation content posted by users on the Website belongs to those users, and the Clinic may use it within the scope of the purpose of operating the Service.
Article 10 (Personal Information Protection)
1. The Clinic protects users' personal information in accordance with relevant laws and regulations, including the Personal Information Protection Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., and the Medical Service Act. Matters concerning the collection, use, provision, and management of personal information shall be governed by a separate "Privacy Policy."
2. The Clinic uses users' personal information only within the scope of the purposes notified at the time of collection and does not provide it to third parties without the user's consent. However, this shall not apply where requested by relevant laws and regulations.
3. Users may request access to, correction of, deletion of, or suspension of processing of their personal information, and the Clinic shall respond without delay in accordance with relevant laws and regulations.
Article 11 (Cookies and Automatically Collected Information)
1. The Clinic may collect and utilize users' access information by using cookies and web analytics tools (such as Google Analytics) to provide personalized services to users.
2. Users may refuse or delete the storage of cookies through their web browser settings, and in such cases, use of some services may be restricted.
3. The items of automatically collected information and the purposes of use are separately provided in the "Privacy Policy."
Article 12 (Disclaimer)
1. The Clinic shall be exempt from liability for providing the Service if it is unable to do so due to force majeure reasons such as natural disasters, war, suspension of service by a telecommunications carrier, or administrative orders related to infectious diseases.
2. The Clinic shall not be liable for service disruptions caused by the user's fault, or unless caused by the Clinic's intentional misconduct or gross negligence.
3. The Clinic shall not be responsible for the accuracy or reliability of information or materials posted by users on the Website.
4. The Clinic shall not be responsible for the content of external linked sites provided on the Website. However, this shall not apply if the Clinic indicates through such links that it recommends or endorses a specific service.
Article 13 (Compensation for Damages)
1. If damages occur to a user in connection with the use of the Service due to the Clinic's fault, the Clinic shall compensate for such damages in accordance with relevant laws and regulations.
2. If damages occur to the Clinic because a user violates the provisions of these Terms or relevant laws and regulations, the user concerned shall compensate the Clinic for the damages incurred.
Article 14 (Dispute Resolution)
1. Disputes arising between the Clinic and users regarding the use of the Service shall, in principle, be resolved amicably through mutual agreement.
2. If the dispute is not resolved amicably, the user may request mediation from the Korea Consumer Agency, the Korea Medical Dispute Mediation and Arbitration Agency, or other relevant dispute mediation institutions.
3. Any lawsuit concerning these Terms shall be under the jurisdiction of the competent court having jurisdiction over the location of the Clinic under the Civil Procedure Act of the Republic of Korea.
Article 15 (Governing Law)
The interpretation and application of these Terms shall be governed by the laws of the Republic of Korea.
Article 16 (Operating Entity)
1. The Website is operated by the Clinic as the provider of the Service, and the technical operation and content management of the Website are performed by the Operator (Obliv & Partners) pursuant to a business agreement with the Clinic.
2. The Operator performs technical maintenance, management, and operational support for the Website, and responsibility for medical practice and the provision of medical information lies with the Clinic.

Supplementary Provisions
Article 1 (Effective Date)
These Terms shall take effect on May 7, 2021.
